RAILROAD INJURY AND FELA LAWYERS

Railroad Injury and FELA Claim lawyers - Railroad Injury Lawyer Texas - Roven Camp

Railroad workers in Michigan are responsible for maintaining the infrastructure that transports people, food, materials, and all kinds of goods across the country.

But despite how important this work is, it’s also one of the most dangerous jobs in the United States. And railroad employers don’t always look out for their employees– in fact, they often abandon them completely after life-altering injuries on the job.

That’s where Roven Camp comes in.

The good news is that railroad workers have rights that protect them against this kind of corporate negligence. At Roven Camp, we have decades of collective experience using these rights to help railroad employees in Michigan get back on their feet after an accident. We know the railroad industry, and we know how to make sure you get the compensation you deserve.

I was in an accident in 2017, and Kevin Camp was brought in to represent me. He did an outstanding job and was always available for questions. This year I received a fair settlement that he helped negotiate.

Workers’ Compensation or FELA?

In other industries, when workers are injured on the job, they often file workers’ compensation claims. But because the railroad is an interstate business, railroad workers are not covered by state-level workers’ compensation laws.

Luckily, the Federal Employer’s Liability Act (FELA) provides federal protections for railroad workers who are injured in workplace accidents. And a FELA lawsuit is almost always better for the worker than a traditional worker’s comp claim.

If you’ve been injured on the job in the railroad industry in Michigan, contact an experienced FELA attorney as soon as possible so you can seek justice.

Qualifications for a FELA Lawsuit in Michigan

FELA was passed by Congress in 1908 as a way to ensure railroad workers are guaranteed a safe workplace. The Act allows railroad workers and their families to recover compensation they need when they are injured in a work-related accident on the railroad.

In order to qualify for FELA, an injured railroad worker must be able to prove the following:

1

The railroad he works for is engaged in interstate commerce (either running across state lines or deals with interstate freight).

2

The injury to the worker is the result of the negligence or carelessness of an officer, agent, or employee of the railroad; or

3

The injury is caused by a defect in the railroad’s cars, engines, appliances, machinery, track, road bed, or any other equipment or road.

What Damages Are You Entitled to Under FELA in Michigan?

FELA was passed in 1908 explicitly to guarantee railroad workers a safe workplace. It grants railroad workers and their families the right to recover compensation from their employer if they’re injured in a workplace accident.

Here are some of the damages that you are entitled to under FELA:

  • Past lost wages
  • Future lost wages as a result of injury or disability
  • Lost benefits, including health insurance
  • Pain and suffering

If you file a lawsuit within 3 years of the date that you knew (or should have known) that you were injured in an accident caused by your employer, there is no cap or predetermined schedule of payments that you can receive. This means that FELA settlements can be very comprehensive.

However, in order to be granted these damages, you have to prove a number of things in court.
