Railroad workers have a long and proud history in Texas. They are the backbone of our transportation system, and their hard work keeps America moving.

Unfortunately, working on the railroad can be dangerous, and railroad workers often suffer serious injuries on the job. If you’re a railroad worker who’s been injured, you need to know your rights under the Federal Employer’s Liability Act (FELA).

Railroad Worker Rights and Protections:

Railroad Worker Rights Under FELA

The Federal Employers Liability Act, or FELA, is a law that provides protections for railroad workers who are injured on the job. Under FELA, railroad workers are entitled to receive compensation for their injuries, and they can also sue their employers if they feel that their rights have been violated.

FELA was passed in 1908 in response to a series of devastating rail accidents that killed or injured thousands of workers. Prior to FELA, there was no legal recourse for injured workers, and they were often left to fend for themselves. FELA changed all that by giving workers the right to seek damages from their employers.

Since its passage, FELA has been amended several times to further protect the rights of railroad workers. For example, the law now requires employers to provide a safe working environment for their employees.

If an employer fails to do so and an employee is injured as a result, the employer can be held liable under FELA.

The FELA Claims Process in Dallas, Texas

It has been our experience that most railroads are no longer interested in making fair and reasonable offers to injured employees without the filing of a lawsuit.

However, with respect to the pre-suit claims process, once you and your railroad injury attorney work together to file your FELA claim, you can expect the following things to happen:

1

Your employer will be notified of the claim and the legal obligation to preserve evidence.

2

You may be asked to provide documentation of your injury.

3

In most cases, the railroad will have performed an investigation into the nature and cause of your injury, including taking statements from witnesses and performing a reenactment of the incident.

4

You may be given a copy of the investigative report or a copy of your report of personal injury. If you are not provided a copy of these items, your local union representative can help obtain a copy for you.

5

A representative from the claims department will likely contact you to request a recorded statement (if you are not represented by counsel). You are not required to provide this recorded statement and in almost every case you should not provide one, especially if you have not discussed your incident with a knowledgeable FELA attorney.
